Off-duty police officer legally intoxicated at time of crash

By Zachary Markovic, zmarkovic@acnpapers.com
Off-duty Plano Police Officer Ray Wildes had a blood alcohol level of .11 when the truck he was driving struck on-duty Plano Police Officer Kenneth Foale’s cruiser, according to an affidavit released Monday.
Wildes is a 6-year veteran of the Plano Police Department and the driver of the Ford F-150 that investigators reported sped through a red light and struck on-duty Foale, who is a 2-year veteran of the Plano Police Department. The truck was traveling eastbound on Legacy Drive. He disregarded a red light, and as a result, struck a marked Ford Crown Victoria.
Foale received multiple fractures in his clavicle and closed head injuries from the accident. According to the affidavit he may still require surgery to repair his shoulder.
The investigating officer left the room to prepare to take Wildes’ statement and record information for the incident, but when he returned Wildes was “unresponsive and sedated.” The investigating officers had a nurse draw blood from Wildes under the implied consent statute since Wildes was unconscious and could not be awakened to provide consent.
This was two hours after the accident and the results from the blood showed Wildes had .11 grams of alcohol per 100 milliliters of blood.
Wildes suffered injuries that required surgery to repair his pelvis and hip, according to the affidavit.
After reviewing the police dash camera footage, it was determined that Foale clearly had a green light for several seconds as he traveled into the intersection. Crash data from both vehicles indicate Wildes was speeding at the time of the accident. It is estimated he was traveling between 59 to 61 mph when he ran a red light and struck Foale’s car.
The police vehicle had been traveling northbound on the service road of Central Expressway and was attempting a left turn onto westbound Legacy Drive on a green light. The truck struck the police vehicle on the front quarter panel. This caused the tail end of the police cruiser to come around and hit the tail end of the truck.

" Are they going to fire him for an example to our children that they keep arresting the kids for alcohol uses? They need to set an example! "

" Why haven't we heard anything new about this? This guy has been seen riding his motorcycle around Plano/Allen and even going on road trips to Big Bend. If one of us would have done this, we would still be sitting in jail. And the police wonder why they can't get any respect! "
