Chiropractor turns self in on 5th sexual assault charge

McKinney chiropractor David Russell turned himself in to police Tuesday on a warrant for aggravated sexual assault of a child, the fifth charge against him in recent months.


McKinney police issued the warrant late Monday after a fifth victim, a child, came forward within the past several weeks with similar sexual-assault allegations against Russell. According to police, she said Russell had molested her during treatment at his office.

Russell turned himself into the Collin County Sheriff's Office on the first-degree felony charge and was later released on a $50,000 bond. Before Tuesday, he had already been out on bond after posting bail on the four previous charges, which accused Russell of sexually assaulting four other female patients, two adults and two children.

"Dr. Russell maintains his innocence on all charges," Russell's attorney, Todd Shapiro, said in a statement to NBC 5. "As with the previous allegations, he looks forward to the day his cases will be heard in a Collin County District Court."

Russell, whose chiropractic license was suspended by the Texas Board of Chiropractic Examiners following the first sexual assault charges a few months ago, previously owned Russell Chiropractic in McKinney. He recently sold his practice, which is now Elite Performance Chiropractic.

McKinney police first arrested Russell in late October, after the original warrant for sexual assault of a child was issued, and he was released on a $100,000 bond. A second arrest warrant for a separate sexual assault of a child charge was issued Nov. 4, and after he was arrested, Russell was again released on a $100,000 bond.

Within a week of Russell's second arrest, two adults reported to police that Russell had sexually assaulted them. Police arrested Russell a third time Dec. 7, after which he posted bonds of $25,000 each for the separate second-degree felony charges.

During a hearing the following week, District Judge John Roach Jr. of the 296th District Court, the same judge who signed the most recent warrant Monday, ruled that Russell's bond for each of the adult-related charges be increased from $25,000 to $100,000. He also ruled that Russell surrender his passport, remain in Collin County unless given permission to leave, and abstain from contact with any person 18 years or younger or with any of the alleged victims.

McKinney police Detective Techia Davis testified during the December hearing that there had been 18 complaints against Russell related to misconduct during treatment. Shapiro, who said many of the complaints such as harassment and "improper touching" were Class C misdemeanors, questioned why they were made only after his client's "face was splashed all over the media."

Russell was arrested in the courtroom after Roach increased his bond to $100,000. He bonded out shortly before 5 p.m. that same day.

Russell again posted bail Tuesday, shortly after turning himself in. He is yet to be indicted by a grand jury.
